The Company and contractual partner of this offer is BALSAN-Cosmetic GmbH, Spitzwegstr. 10, 85521 Ottobrunn

By submitting the order, the buyer shall recognize the following conditions for both parties as binding. An order constitutes the coming into existence of a contract.

1. Pricing

All prices are to be understood as including legal value-added tax and subject to shipping costs.
The prices are always subject to change. The prices valid on the day of delivery apply.

2. Shipping costs

The following lump-sums apply for packaging and shipping:

The deliveries are made by parcel service within the EU and by postal parcel for shipments worldwide.

For cash on delivery deliveries, additional costs are incurred.

If all articles are not able to be delivered and if the customer requests a partial delivery, the shipment costs are incurred by the customer once.

3. Partial deliveries

Partial deliveries are only performed upon the written request of the customer.

4. Return of goods

The return of goods for which the remote sales law does not apply can only be accepted upon previous agreement. A credit in the full amount of the value of the goods is issued only if the goods are sent in their original packaging. In other cases, we reserve the right to charge for the costs incurred.

5. Right of withdrawal

The consumer as defined in Section 13 of the German Civil Code (persons acquiring goods for a purpose that cannot be ascribed to either their commercial or independent occupation) are, according to Section 361 of the German Civil Code, entitled to right of withdrawal. The right of withdrawal begins at the time at which the customer is provided with clear notification of his right to withdrawal on a permanent data medium. This notification shall inform the customer of his right in accordance with the requirements for the means of communication used. The period within which the withdrawal can be made is two weeks. The withdrawal does not require any justification. Sending the notification of withdrawal on time to BALSAN-Cosmetic at the address given above suffices for complying with the return period. The goods must be returned to this address. A right of withdrawal does not exist for contracts entailing the delivery of goods that are prepared according to the customer’s specification.

6. Rectification of defect – guarantee

During the guarantee period of 24 months after delivery, the customer has the right to rectification of defects at no charge. If required, the goods will be exchanged at the cost of BALSAN-Cosmetic GmbH. The customer’s right to annulment and reduction is initially ruled out. However, if the defect is not rectified within an appropriate amount of time, the customer shall have the option of either exercising his right to recession of the contract of sale (annulment) or to lowering the purchase price (reduction). The original packaging must be used for returns, and for technical devices, the warranty and service documents must be included.

7. Conditions of payment

The invoice becomes due for payment 30 days after the invoice date at the net amount without deductions.
The goods remain the property of the deliverer until complete payment is made.

8. Security

Personal data of importance for us are saved as long as this is permissible under the German Data Protection Act.
All specifications made by the customer are only used for internal purposes and are not passed on to third parties.
The e-mail addresses are neither passed on nor are they used for promotional purposes, unless the customer requests so explicitly.

9. Delivery period

Delivery is performed within three working days, unless special arrangements have been made.

Place of performance and jurisdiction for the obligations of both parties from the contractual relationship is Munich-Ottobrunn.
